Terms and Conditions - Denis M. Kitchen, Mental Health Counselor

These Terms and Conditions govern your use of the SMS/text messaging and optional email newsletter services provided by Denis M. Kitchen (the "Provider") via an AI assistant tool (OpenClaw).

1. Service Description

The Provider uses platform-automated and AI-powered assistant to send limited, informational or transactional SMS/text messages and/or emails related to your mental health counseling services. Examples include session reminders, summary notes (anonymized), resource links, or other non-promotional communications you have explicitly requested or consented to.

2. Opt-In and Consent

By providing your mobile phone number and/or email address, you expressly consent to receive these messages and/or emails. Consent is obtained verbally during sessions, in writing, or through direct agreement. This is not a marketing service — messages are for your personal use and care coordination only.

You may opt out of SMS/text messages at any time by replying "STOP" to any message. You will receive a confirmation message. Opting out of SMS does not automatically opt you out of email communications (if separate consent was given). To opt out of email, reply "UNSUBSCRIBE" or click the unsubscribe link in any email.

3. Message Frequency and Content

Message frequency is low and irregular (typically 0–5 messages per month). Content is informational/transactional only — no marketing, promotions, or sales offers. Carriers are not liable for delayed or undelivered messages.

4. No Guarantee of Delivery

The Provider uses third-party services (Twilio) to send messages. Delivery is not guaranteed and may be affected by carrier filtering, network issues, or device settings. The Provider is not responsible for non-delivery.

5. Data Usage

Your phone number and/or email address is used only for the purposes described. No personal information is sold, rented, or shared with third parties for marketing. See the separate Privacy Policy for full details.

6. Changes to Service

The Provider may modify or discontinue the messaging/email service at any time without notice. Continued use after changes constitutes acceptance of updated terms.

7. Limitation of Liability

The Provider is not liable for any damages arising from use of the service, including but not limited to non-delivery, incorrect information, or reliance on AI-generated content. Messages are for informational purposes only and do not constitute medical advice.

8. Governing Law

These terms are governed by the laws of the State of Florida, United States.
